Tshabangu reprieve as judge blocks CCC bid to recall politician

Harare High Court judge Mary Zimba-Dube has reversed a decision by the Welshman Ncube led CCC to expel Sengezo Tshabangu, a situation that had given the opposition party some grounds to recall the troublesome politician from the senate.
Tshabangu, who styles himself as CCC interim secretary general, was expelled in February this year by CCC following a disciplinary committee hearing that found him guilty of four counts of misconduct.

This was after the controversial politician and Matabeleland senator, who ruffled many feathers by ordering multiple recalls on CCC MPs and councillors elected 2023, had made changes of CCC Parliamentary Portfolio holders without the authority of the party leadership.
Soon after the expulsion, Ncube and his party did not hide their intentions to recall Tshabangu, who rushed to the High Court to pre-empt his demise by challenging the decision to expel him from the party.
Tshabangu had argued that the term of office of the disciplinary committee that decided his fate had expired.
He said that CCC’s office bearers and main organs were elected on 26 May 2019, meaning that their five-year tenure expired on 27 May 2024.
In his court challenge, Tshabangu cited as respondents, disciplinary committee members comprising Sesel Zvidzayi, Concillia Chinanzvavana, Gilbert Kagodora, Shepherd Mushonga and CCC as a party.
But in a judgement, Justice Zimba-Dube declared Tshabangu’s expulsion was “null and void”.
“Accordingly, it is declared and ordered as follows: The term of office of the first to fourth respondents and main organs elected on 26 May 2019 at the Gweru Congress, save for its Parliamentary Caucus and Local Government Caucus as set out in Article 6 of its Constitution expired on 27 May 2024 and hold office unlawfully and in breach of article 6.2.2 as read with Article 6.3.3(g) of the Party’s Constitution.
“The entire disciplinary process constituting the Disciplinary Committee that sat at number 60A Hibiscus Road, Lochnivar, Southerton, Harare on 12 February 2025 to deliberate and decide on allegations of misconduct levelled by the fifth respondent against the applicant be and are hereby declared null and void and are set aside,” read the judgement.
