Biti convicted of verbal assault on Russian businesswoman

CCC politician accused of calling Tatiana Aleshina stupid

Opposition CCC politician and lawyer Tendai Biti has been convicted of charges of verbally assaulting Russian businesswoman and investor Tatiana Aleshina at the Harare Magistrates’ Court back in 2020.

Presiding magistrate Vongai Guwuriro postponed the matter to this Tuesday for mitigation and sentencing.

Biti was accused of assault by gesture and by word.

He is alleged to have called Aleshina stupid and also pointing a finger towards her in a manner she adjudged was threatening.

Biti’s lawyer Alec Muchadehama said they were going to appeal the court verdict.

“We contest the verdict of guilt and we are going to appeal to the High Court on various grounds.

“One; on the basis that we felt strongly that this was a constitutional matter which ought to have been referred to the constitutional court.

“We also contest the legality of section 89 (1)(b) under which he was charged.

“We also contest the findings of the magistrate that the witnesses were credible and we also contest the fact that Tendai’s evidence was not rebutted by the state,” Muchadehama said.

He was being represented by Alec Muchadehama, had denied the charges.

In convicting him, Guwuriro said in much of his defence, Biti alleged that his constitutional rights were being violated but failed to submit any evidence to that effect.
